A truck driver is checked at a highway rest area. His driver card was left in the drawer of his desk, forgotten after a long weekend. The tachograph has been running without a card since the morning. Within minutes, the inspector notes the violation, and the situation changes. Driving without a CQC card or without a driver card in France exposes one to heavy penalties, but the exact nature of these penalties depends on the missing document.

CQC card and driver card: two documents, two distinct violations

The CQC card (Certificate of Professional Qualification) is often confused with the driver card of the tachograph. The former certifies that the driver has completed the mandatory training (FIMO or FCO) to engage in the road transport of goods or passengers. The latter is used to record driving and rest times in the digital tachograph.

The absence of one does not lead to the same legal consequences as the absence of the other. A driver can hold their professional qualification up to date while driving without a card inserted in the tachograph, and vice versa. During a roadside check, law enforcement verifies both.

This distinction also matters for the employer, as their responsibility is engaged differently depending on the document in question. When considering driving without a CQC card in France, one exposes themselves to a legal framework that targets both the employee and the transport company.

Criminal penalties for lack of professional qualification

Driving without a valid CQC card amounts to engaging in professional transport activity without qualification. The transport code provides for a penalty for the driver of up to six months in prison and a fine. The employer who allows an unqualified driver to take the wheel faces the same penalties, in accordance with Article L.3315-6 of the transport code.

In practice, the procedure does not stop at the fine. Here’s what can happen during a check:

  • Seizure of the vehicle on-site until a qualified driver is presented or the situation is regularized
  • Report sent to the public prosecutor, with the possibility of criminal proceedings against the driver and the transporter
  • Entry of the violation into the national electronic register of transport companies, which can weigh in during the renewal of the community license

The employer cannot plead ignorance. It is their responsibility to verify the validity of the CQC before each shift, and to maintain an up-to-date file for each employed driver.

Driving without a card in the tachograph: the most common trap

The most common case on the ground remains driving without a driver card inserted in the tachograph. Forgetfulness, loss, theft, expired or defective card: the reasons vary, but the device systematically records the absence of a card. The digital tachograph keeps track of every minute driven without a card.

Law enforcement detects this anomaly within seconds during a data download. With the deployment of second-generation smart tachographs, detection can even occur remotely, before the vehicle stops, via wireless communication that alerts control teams to anomalies.

Tolerance exists, but it is regulated

European Regulation No. 165/2014 provides a precise framework in case of loss, theft, or malfunction of the card. The driver can continue to drive temporarily, provided they print the tachograph data at the beginning and end of each working day, manually record their personal information and activity periods on the ticket, and can justify the situation during a check.

Responses vary regarding the tolerance granted in practice: some inspectors accept the manual procedure without difficulty, while others issue fines if the request for replacement has not been made in time. The official rule requires requesting a replacement card within seven calendar days.

Consequences on the employment contract

Beyond the fine, driving without a driver card can justify dismissal. The Court of Appeal of Metz upheld the dismissal for real and serious cause of a truck driver who had driven without a card for six days. The judge considered that this conduct put the employer in violation and constituted a serious breach of the employee’s contractual obligations.

Six days without a driver card is enough to lose one’s job. This legal precedent reminds us that the driver’s responsibility is not limited to the risk of a traffic fine.

FIMO training, FCO renewal: anticipate to avoid the situation

The CQC card is linked to initial training (FIMO) and mandatory continuing education (FCO), renewable every five years. A driver whose FCO has expired loses the validity of their qualification, even if the plastic document remains in their possession.

Several situations lead to driving without a valid CQC:

  • Postponement of the FCO beyond the expiration date, due to negligence or difficulty in finding a training slot
  • Change of transport category (from goods transport to passenger transport) without additional training
  • Foreign drivers whose qualification equivalence has not been formalized with the prefecture

The file for each driver must mention the expiration date of the FCO. A rigorous follow-up of these deadlines avoids the majority of violations. The transport company managing several dozen drivers has an interest in automating this follow-up, as a single oversight is enough to trigger a procedure.

The penalty affects the transporter as much as the driver. An employer who allows a driver with an expired qualification to leave takes the same legal risk as one who hires a driver without training. The national register of transport companies keeps a history of violations, which directly impacts the reputation and operational capacity of the company.
